Interviewed along with the rest of the cast on the YouTube channel Jake’s TakesColin Farrell revealed that Penguin he will not have the iconic cigar seen in the comics and consequently will not be able to smoke. These are his statements:

“I have to say I struggled to get a cigar. At one point I asked if I could have one turned off, but I was denied. The Oswald Cobblepot that fans will see in the film has not yet fully embodied the essence of the comic book Penguin. At present he is only a henchman of Falcone, but there are great ambitions in him to dominate Gotham. I would like to explore this side of him in the future ”.

We already know that in The Batman the Penguin will have a limited screen time, but the character is expected to return in a spin-off of his own made exclusively for HBO Max. Director Matt Reeves also said he was thrilled to be able to explore his Bat-Verse with new projects.
